Stupid Raisins LLC Terms of Service

Welcome to Stupid Raisins! These Terms of Service (“Terms”) govern your use of our website (stupidraisins.com), desktop app, plugins, and related services (collectively, the “Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Who We Are

The Services are operated by Stupid Raisins LLC, located at 9682 North 6000 West, Highland, UT 84003, United States.

2. Eligibility

You must be at least 13 years old (or 16 in some regions) to use our Services. By using the Services, you represent that you meet this requirement.

3. Accounts

Some features may require creating an account. You agree to provide accurate, complete, and current information, and to keep your login credentials secure. You are responsible for all activity under your account.

4. Purchases & Subscriptions

If you purchase plugins, memberships, or subscriptions through our Services:

Payments are processed securely by Stripe. We do not store full credit card details.
Subscriptions renew automatically unless canceled before the renewal date.
You may cancel anytime; your subscription will remain active until the end of the billing cycle.
We may change pricing with notice. Continued use after changes constitutes acceptance.

5. Intellectual Property

All content, plugins, software, graphics, and branding provided through the Services are owned by or licensed to Stupid Raisins LLC and protected by copyright, trademark, and other laws. You may not copy, distribute, modify, or reverse engineer our products without permission.

6. End User License Agreement (EULA)

When you download, install, or use our plugins or software (the “Licensed Software”), you are granted a perpetual, worldwide, non-exclusive license to use the Licensed Software for both personal and commercial projects, subject to the following:

Permitted Use:
- You may install and use the Licensed Software on as many computers as you personally own or control.
- You may use the Licensed Software to create videos and related content for yourself, your business, or your clients.
- You may distribute videos and projects created with the Licensed Software without restriction.
Prohibited Uses:
- You may not resell, redistribute, share, sublicense, or otherwise make the Licensed Software itself available to others, in whole or in part.
- You may not reverse engineer, decompile, modify, or attempt to extract source code from the Licensed Software.
- You may not use the Licensed Software for unlawful, harmful, or abusive purposes.
Ownership: Stupid Raisins LLC retains all rights, title, and interest in the Licensed Software. You are purchasing a license to use it, not ownership of the software itself.
Termination: Your license will remain valid as long as you comply with these terms. It may be revoked if you violate this agreement.

7. User Content

If you submit feedback, suggestions, or other content, you grant Stupid Raisins a non-exclusive, royalty-free license to use it for business purposes. You are responsible for ensuring your content does not infringe others’ rights or violate the law.

8. Prohibited Uses

You agree not to:

Use the Services for unlawful, harmful, or abusive purposes
Interfere with or disrupt the Services
Attempt to gain unauthorized access to accounts or systems
Resell, redistribute, or sublicense our plugins without written consent

9. AI Features (e.g., Caption Pop AI)

Third-Party Providers: Some plugins use third-party AI services (such as AssemblyAI or Apple) to generate captions or other outputs. By using these features, you also agree to those providers’ terms and privacy policies.
Accuracy: AI outputs may contain errors, omissions, or inaccuracies. They are provided “as is” and should not be relied on for legal, medical, or sensitive purposes.
User Responsibility: You are responsible for reviewing and editing AI-generated content before publishing or distributing it.
Data Processing: Your content may be securely transmitted to third-party AI providers for processing. We do not sell this data; it is used only to deliver the requested service.
Prohibited Uses: You may not use AI features to create unlawful, harmful, or misleading content (including deepfakes, harassment, or deceptive materials).

10. Disclaimers

The Services are provided “as is” and “as available.” We make no warranties, express or implied, about availability, reliability, or fitness for a particular purpose. Use the Services at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Stupid Raisins LLC is not liable for any indirect, incidental, or consequential damages arising out of your use of the Services. Our total liability for any claim shall not exceed the amount you paid us in the past 12 months.

12. Termination

We may suspend or terminate your access to the Services if you violate these Terms. You may stop using the Services at any time.

13. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the new Terms. The latest version will always be posted here.
